In the City government’s own words.
This is based on lawsuit 23STCP00644 Johnson v. City of Los Angeles (Los Angeles Housing Department). Petitioner (tenant) filed a Petition for Writ court action (2/28/2023) to force city government to require property owner to provide tandem parking and working intercom system. At the time of the action, owner had installed an intercom system at the building but with a broken non-working connection in the Petitioner unit; Petitioner’s rent agreement stated parking for vehicle 1 and 2 and specifies stall 8 but does not specify is stall 8 a one car stall or a two car stall. (For four years prior, the Black tenants were assigned to a two car tandem stall.) The rent agreement is silent on the intercom system. State of California law recognizes oral agreements and conduct of the parties, and states that rent agreements of less than one year do not have to be in writing. The rent agreement as well as city law state that housing services are “including but not limited to” which IMO means if a tenant is receiving the housing services, then that is an entitlement whether in writing or not. The City under Mayor Karen Bass seems to take the position that if services are not in writing, they are not enforceable. This document is a small part of the lawsuit, as the City under Mayor Karen Bass wrote and filed with the Court thousands of pages, which would deny Black tenants a working intercom connection and parking for two cars. (Karen Bass was elected Mayor in 2022.)
