LOS ANGELES. Attorney Michael Gerst says the city has denied Black, elderly, disabled tenants housing services for over ten years. Gerst is Novian and Novian LLP lawyer for property owner Hi Point 1522 LLC and Power Property Management Inc
The words of Los Angeles Mayor Karen Bass city attorney Deborah Jeanne Breithaupt state bar #170206:
“Race, Nazi, Lynching and disembowelment, successive liability for a nuisance, tenant was forced to move from a tandem two car stall to a one car stall, from #14 to #8, time barred allegations from 2010 and 2014, LA County Health Department Orders, New Unruh Act and Civil Code discussion, discrimination, retaliation, adverse action, and conspiracy; commentary on the City’s Tenant Anti-Harassment ordinance, damages and California Tort Claims, city mandatory duties, Racial definition, plantation owners, pattern and practice conclusions, falsification of documents, race claims against the City, nine year period of protected activity.” (Dec 5, 2023, City RJN. “Breithaupt and Gerst said that state bar complaints have been filed against them. Breithaupt said that the City and property owner agree that the matter is one of ongoing harm suffered by Petitioner.” Attachment from GJ Johnson to Public Comment submitted January 8, 2023. (Above quote from Notice of Continued Trial Setting Conference dated Dec 12, 2023.)
“When Jimmy Grimaldi‘s white mom (sic) moved into this subject address in 2022 January, it didn’t take eight years for the owner to give her a working Intercom and tandem parking stall. When the intercom system was replaced on the outside of the building in 2015 it did not take eight years to replace it. (When) the Akuvox door entry and intercom system was installed on the outside of the building in April 2023, it did not take eight years for that installation to occur. Exh 27, pages 72-83, Exhibit List page viii.” (January 3, 2024. Filed Opposition to Motion to Strike. Page 6).
“Lawyer Michael Gerst communications say his client HI POINT 1522 LLC and city employees are racist and retaliatory and intentionally harm Black tenants by denying housing services for over ten years. Gerst says his client and city continues to deny housing services and refuse to discuss a requested reasonable accommodation due to Blackmans race, age, sex and disability. Gerst however admitted that the Blackman tenants are entitled to a tandem parking stall and a working intercom in their apartment. The question remains when? Can Mayor Karen Bass answer the question? Must Black tenants wait another ten years for housing services? Exh 27, pages 72-83, Exhibit List page viii.” (January 3, 2024. Filed Opposition to Motion to Strike. Page 6)

I agree. Thanks for that. If in California, check out the state Unruh Act as regards the rights of the individual. If in other states, see if you have similar rights. The Unruh act is patterned after the Public Accommodations law 42 U.S. Code § 2000a – Prohibition against discrimination or segregation in places of public accommodation. “(a) Equal access
All persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, as defined in this section, without discrimination or segregation on the ground of race, color, religion, or national origin.” This law can apply to private landlords as well as local government agencies.

As my pastor used to say, it is useless to complain to government agencies about racism because they are predominantly the ones perpetuation racism.
