CALIFORNIA. Few states have a law like the Unruh Act CC sections 51,52. The California Unruh Act is powerful because to prove a violation, intent is needed by not disparate impact or disparate treatment. Also, government entities can be held liable under the Unruh Act. Unruh can be used to fight housing discrimination, as well as unlawful treatment when denied business services.
“The Unruh Civil Rights Act (California Civil Code Section 51) provides protection from discrimination by all business establishments in California, including housing and public accommodations, because of age, ancestry, color, disability, national origin, race, religion, sex and sexual orientation. Other State laws relating to prohibitions of discrimination based on disability include California Civil Codes Sections 54 through 55.2 .” (Source California Department of Rehabilitation)
The Unruh Act protects the rights of the individual.
“The Unruh Civil Rights Act (colloquially the “Unruh Act”) is an expansive 1959 California law that prohibits any business in California from engaging in unlawful discrimination against all persons (consumers) within California’s jurisdiction, where the unlawful discrimination is in part based on a person’s sex, race, color, religion, ancestry, national origin, age, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status. The Unruh Act applies to all businesses in California including: hotels and motels, restaurants, theaters, hospitals, barber and beauty shops, housing accommodations, and retail establishments. “All persons within the jurisdiction of this state are free and equal, and no matter what their sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation are entitled to the full and equal accommodations, advantages, facilities, privileges, or services in all business establishments of every kind whatsoever.” (Unruh)
Supposedly the State Civil Rights Department enforces the Unruh Act. Good luck trying to complain to them.
