How the CA DFEH stops complaints about racism

In my opinion. The state department of fair employment and housing claims on its website that it processes complaints under the Unruh act for Housing discrimination. Housing complaints can also be processed under the government code 12955. The Unruh act CC section 51 is different from GC section 12955. GC 12955 requires a showing of disparate impact or disparate treatment to prove discrimination; however under Unruh CC 51, there are no such requirements; the main difference under Unruh is that you must prove the discrimination was intentional.

I was recently very surprised when I viewed the DFEH automated complaint process. If you try to file a housing complaint under Unruh, this is what pops up and prevents you from going further: “Is the business you are filing this complaint against related to residential buying, leasing, or renting (including issues with a homeowner’s association)?” If you click “yes”, the form will not let you proceed and states, “The Unruh Civil Rights Act provides protection from discrimination of harassment by a business establishment that you are seeking service from. However, if you believe you have been subjected to discrimination, harassment, and/or retaliation by a business related to residential buying, leasing or renting, go back and complete the Housing Intake form instead.” The problem here is the that the legal requirements under Unruh differ from the legal requirements under GC 12955, hence the intake questions have to be different and I suggest the DFEH is no longer processing intakes that take into account the Unruh definitions. Hence you may fill out the wrong questionnaire and the DFEH will not so quietly push you in the wrong direction.

This is what the DFEH website says: “The Unruh civil rights act provides protection from discrimination by all business establishments in California, including housing and public accommodations.” It says “including housing” so why did the DFEH take down the Unruh Housing Intake without explanation?

The DFEH also says in its efforts to unfairly protect businesses: “The misconduct or disruptive behavior of particular individuals may be grounds for refusing to do business with them or denying them services.” Really? And what law is that based on? What case law is that based on? Does the DFEH know that the legislature declared that discrimination “foments social unrest” meaning the act of racism is what causes people to be disruptive. Is the DFEH saying that even if you have a rent agreement, that because you are argumentative, you can be denied housing services? What is the DFEH definition of misconduct? Isn’t complaining about racism supposed to be protected activity? Not according to Gavin Newsom’s DEFH.

I file this complaint because the DFEH system would not allow me to file a housing complaint under Unruh. To that extent, the DFEH website says a housing Unruh complaint can be filed but the automated system does not allow it saying that Unruh cannot be filed for housing discrimination, which is untrue based on the DFEH website and based on the state law that allows a housing discrimination complaint to be filed with Unruh as the violation and not having to cit any other law. To that extent the DFEH is racist, the director of DFEH is racist, and DFEH employees Monique Webb and Joanna Gonzales are racist because they have acted in concert denying my right to file an Unruh Housing Complaint. On or around July 9, 2021, Hi Point 1522 LLC purchased this building address. At the time there were pending Unruh Act housing complaints of racism charged against the Hi Point 1522 LLC employee Power Property Management Inc. On or around July 9, 2021, Hi Point 1522 LLC was made aware of the DFEH and other complaints by myself by email .The owner and management and resident manager Kassandra Harris have denied me full and equal services and/or privileges to intercom maintenance, and denied me available parking, and refused to respond to my complaints. As retaliation because I complained, said entities have continued to deny me intercom maintenance, and denied me available parking, and refused to respond to my complaints. Thus, I also complain that the respondents have retaliated against me because I complained numerous times by email, fax, or otherwise. All rights reserved to add to this description. I request damages under the Unruh act of $4,000 for each day that the respondents have denied me full and equal accommodations, advantages, facilities, privileges, or services, and for each day they have done so to retaliate against me, and such actions intentional to cause damages to me no matter what my sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status. I have asked the owner to supply me an application for additional parking and the owner has refused to respond in retaliation. California recognizes joint and several liability. This is an Unruh complaint for housing discrimination. The DFEH employees has harassed and intimidated me to stop me from filing this complaint. The owner was told about racism charges by email dated 8/2/21 at 9:28 am as attached herein. Post cards on this matter were mailed to the owner on 9/18/21.
