This is an FYI Notice.
I have filed a few labor complaints over the years. There were a few decisions in my favor.
Right now I have pending cases all involving the same issue as failure to provide tools to perform job duties, failure to compensate for using own tools, and retaliation because I complained. Case numbers include : WC-CM-890340, WC-CM-947043, RCI-CM-946923, et al. The defendants are all the same : Robert Half Legal, Activision, Roth Staffing, Williams Lea Agency.
I am a former government official. I have also filed complaints with agencies like the California Civil Rights Department (“CRD”) , and the EEOC, and the EDD.
I once filed the almost same case for ten years straight with the CRD and same defendants but based on new evidence each time. The CRD investigators kept steering me away from the type of Unruh complaint I tried to file. For years they kept rejecting my complaints saying I did not have “causation”. Then after years of trying, they finally said I had causation and had me sign the complaint. The investigator claimed that the defendant denied all of my accusations, but (unlike the EEOC), the CRD would not give me a copy of the statement of the defendants so I could have fair opportunity to respond. Then the CRD dismissed the complaint claiming “insufficient evidence” without of course ever telling me what evidence they were seeking or what was deficient. These cases were about disability request for reasonable accommodation and Unruh act violations.
Now back to my pending labor cases. I am told that there is a three to five year wait for these complaints to go to hearing, not including a “conference”. That is particularly appalling to hear. IMO 99% of people in life do not complain about almost nothing. Out of that 1% left, few will have the guts or lawyer $$$ to hang in there. The system favors the defendants because who in their right mind would file a labor claim —-or any complaint—-and want to wait five years for a possible resolution? So basically back to square one in that most people do not complain. So these government agencies just became a paper mill of complaints where almost no one is ever found liable. Wow! What a government operated immoral racket and scam!
I think I filed about two Chapter 13’s in my life, and did so without a lawyer. I was of the few people who made it thru all the plan payments. A similar situation exists with court appeals. Everyone knows that only about 3% of cases are ever overturned. Even some Judges question the value of such a system and the costs involved.
